Can You Still Sell a House Facing Foreclosure in Palmdale?

Yes. A recorded Notice of Default does not take the house or your right to sell it. You are still on title, with the power to sign a listing and a purchase agreement. What the notice does is start a clock, and which version of the sale you are in comes down to one number: what the house would sell for today, measured against everything recorded against it, not just the first mortgage. Underwater, the proceeds will not cover the payoff, so the sale needs your lender’s cooperation — a negotiation with a loss mitigation department rather than a listing with a discount attached. And doing nothing has a price: a California nonjudicial trustee’s sale is final, with no redemption period and no window to buy the house back. Where Does a Palmdale Foreclosure Actually Happen?

Almost none of it happens in Palmdale, which is part of why it feels so remote. Knowing where each piece lives makes it obvious what is a real document and what is a marketing letter.

The recordings. Your Notice of Default and Notice of Sale are recorded with the Los Angeles County Registrar-Recorder/County Clerk. You do not have to drive to Norwalk to see them: the branch serving the Antelope Valley is about ten miles north, at 44509 16th Street West in Lancaster. It also holds every recorded deed, lien, and abstract of judgment on your property — exactly what a title company pulls the day you list.

The court file, when there is one. Lawsuits against Antelope Valley residents are usually heard in the Los Angeles Superior Court’s North District at the Michael D. Antonovich Antelope Valley Courthouse, 42011 4th Street West in Lancaster; there is no civil courthouse in Palmdale. Wherever a judgment comes from, though, it only touches your house when the creditor records an abstract of judgment with the county recorder.

The auction. This is the one that surprises people. Los Angeles County trustee’s sales are almost never held in the Antelope Valley. The two venues that come up most often are Civic Center Plaza at 400 Civic Center Plaza in Pomona, which notices describe as behind the fountain or in the courtyard, and the Vineyard Ballroom at the DoubleTree Hotel Los Angeles-Norwalk, 13111 Sycamore Drive. Pomona is roughly sixty miles down the 14. Your Notice of Sale names the exact place, date, and time, and that controls. The practical point holds: a Palmdale house can be sold on a weekday morning sixty miles away, and nobody has to remind you it is happening.

The California foreclosure calendar, step by step

  1. The delinquency builds. Federal mortgage servicing rules (12 C.F.R. § 1024.41) generally keep a servicer from making its first foreclosure filing before your principal-residence loan is more than 120 days delinquent. In California that first filing is the Notice of Default — and this stretch is the one most people spend hoping instead of acting.About 120 days
  2. The Notice of Default is recorded. Civil Code § 2924 then requires a minimum of three months before any Notice of Sale can issue — the period everyone calls the ninety-day window, though three months is the accurate term.   3. The Notice of Sale is recorded. It must be recorded, posted on the property, published, and mailed at least twenty days before the sale. The trustee may record it up to five days before the three-month period ends, but the sale date can be no earlier than three months and twenty days after the Notice of Default was recorded — which is the real floor, not a clean four months.20 days minimum
  4. The trustee’s sale, and the levers that move it. A sale date is not a wall. You also keep the right to reinstate the loan by curing the default up to five business days before the sale. Servicers sometimes postpone, at their own discretion, while a complete short sale package is in review. Separately, AB 2424 requires a 45-day postponement, by operation of law, on a home of four units or fewer when a signed listing agreement with a California-licensed broker reaches the trustee at least five business days before the sale. Three details decide whether it fires: the listing has to be a real one, placed on a publicly available marketing platform rather than held in a pocket; the trustee must receive it from the homeowner, not the agent; and it must arrive by certified mail or overnight courier with tracking confirming signature and time of receipt. One more protection does real work on files that start late. The same rules generally provide that when a servicer receives a complete loss mitigation application more than 37 days before a scheduled sale, it has 30 days to evaluate it and generally may not conduct the sale while that evaluation is pending. The operative word is complete: an application missing two documents is not an application. The smallest servicers are exempt from that evaluation requirement, though they still cannot file before 120 days or foreclose while you are performing under a loss mitigation agreement. It is also generally one bite: a servicer only has to run this process once per loan unless you brought the loan current in between.

What Shows Up on a Palmdale Title Report?

When you list, the title company pulls everything recorded against the property, and in a short sale every claim has to be resolved before escrow closes. Palmdale files carry a recognizable mix. A judgment lien from an old debt

An old credit card, a medical bill, or a business debt that went to court can end up attached to your house — but only when the creditor records an abstract of judgment with the county recorder, which usually happens long before anyone tells you. The court that entered the judgment does not control that; the recording does, and a judgment from any court can be abstracted and recorded here. These creditors can sometimes be negotiated down, and California’s homestead exemption may give you leverage, though how much depends on the debt and your circumstances. Unpaid property taxes, or an IRS or state tax lien

Past-due county taxes are usually a line item, not an obstacle: escrow clears them at closing out of proceeds. A recorded IRS or Franchise Tax Board lien is different, with a discharge application that has its own review queue and has to be filed early enough to land before closing. A code enforcement or HOA balance

Two animals that behave alike at closing. If the city abated a nuisance, California law lets it either record an abatement lien or put the cost on the tax roll, and the route it chose changes where the claim sits in line. Several west Palmdale tracts, Anaverde among them, also sit in a homeowners association, where unpaid assessments become a recorded lien with collection costs attached. How Does Our Short Sale Process Work in Palmdale?

Here is the sequence, and where the time goes.

  1. Position check, including the tax bill. Payoff, recorded claims, a realistic Palmdale value, and any sale date. Worth naming plainly: most of the letters arriving at a Palmdale address after a Notice of Default come from people who want to buy the house at a discount. Will I Owe Money After the Sale?

The question that keeps people from calling, and it splits in two.

On the lender side, California does most of the work: once the holder of a mortgage or deed of trust consents in writing to a short sale of a home of four units or fewer, Code of Civil Procedure § 580e generally bars a deficiency. It does not reach corporate, LLC, or limited partnership borrowers, or fraud or waste. Claims that are not mortgage debt sit outside it, which is why an HOA balance, a judgment lien, or a tax lien is a negotiation rather than an automatic release. On the tax side, forgiven debt can be reported on a Form 1099-C. The exclusion most sellers reach for now is insolvency, which does not expire but applies only to the extent you were actually insolvent when the debt was discharged; the mortgage-debt exclusion people remember from the last downturn expired at the start of 2026. On a purchase-money loan there may be no cancellation-of-debt income to exclude at all — a question for your tax professional.

My income changed and the payment stopped working

Two income shocks are especially common here: aerospace and defense work tied to program and contract cycles at Plant 42, and a long commute down the 14 that gets expensive fast when hours are cut. Either is a documentable hardship, which matters, because a short sale review turns on the hardship narrative and the paperwork behind it. What hurts a file is waiting until six payments are gone to say anything.

It is a VA or FHA loan

Then the rules differ, and government-backed loans are common across the Antelope Valley. FHA runs a formal pre-foreclosure sale program, and the foreclosure timeline changes how it works rather than closing it off. Once the first legal action to initiate foreclosure has occurred, HUD no longer allows a four-month marketing period, so the file generally has to arrive with an acceptable contract already signed and the approval window is sized only to the time needed to close escrow. That is why the call needs to happen early — and why it is still worth making late. VA short sales, still widely called compromise sales, are usually approved by the servicer, but VA sign-off is required on files carrying an outstanding partial claim, a COVID-era partial claim payment, or a COVID-era refund modification, so that history has to surface at the start. The house came to me when a parent died

Common in the older Palmdale tracts: a house that needed work for a decade, a loan nobody has paid since the funeral, heirs in three counties. A short sale out of an estate is doable. What decides the timeline is not the mortgage but who has authority to sign — probate, a trust, the successor trustee. Sorted at the start it is paperwork; found in escrow it kills the closing.

It is listed already and nothing is happening

Silence is rarely mysterious once someone reads the file. Usual causes: a document the servicer asked for that nobody relayed, a package that aged out, a negotiator change that restarted the file, a low valuation nobody challenged, a junior lienholder nobody contacted. If you are under an exclusive listing agreement we will not touch it — once your broker releases the file we are glad to say plainly what we see.

It can. A short sale review turns on a documented change in income or expenses, not on whether the story sounds dramatic. Reduced hours, a contract that ended, a transfer, a commute that got more expensive — all ordinary hardship material, as long as the paperwork shows it: pay stubs from before and after, an employer letter, bank statements that match. What weakens a file is a hardship described in the letter but invisible in the documents.

The city recorded an abatement lien on my Palmdale property. Can I still sell?

Yes. When a city abates a nuisance, California law gives it two alternatives: record an abatement lien, which carries the priority of a judgment lien, or place the cost on the tax roll as a special assessment collected like a property tax. Neither blocks a sale, but the charge has to be resolved before escrow closes, and which route the city took matters, because it changes where the claim sits in line against your mortgage.

Do I have to pay you anything up front?
